The Role

We are hiring a Commercial Director to support the design and construction of a major transportation capital project in Calcasieu Parish, Louisiana, along with ongoing operation of a transportation project in Plaquemines Parish, Louisiana. We seek applicants with experience working in construction, reviewing and negotiating contracts, negotiating commercial settlements, and managing disputes. A successful candidate will be able to demonstrate that they have delivered innovative win-win solutions, built strong relationships with partners and clients, and can work independently.

Responsibilities  

  • Develop an in-depth understanding of the project agreements, and related sub-agreements (e.g. services and construction contracts, etc.), develop an inventory of deliverables for Plenary and its partners, and implement a system to manage the timely delivery of obligations.
  • Act as one of Plenary’s small team of key representatives on the project and develop strong working relationships with construction, services, and public-sector partners.
  • Review project documentation and correspondence prepared by others (e.g. change orders, delay and/or compensation requests, dispute notices) and support associated processes pursuant to the various project agreements
  • Coordinate with Plenary’s in-house technical, construction, and services experts to drive best-for-project commercial decisions and lead commercial strategies to protect Plenary’s interests in the project.
  • Prepare regular monthly and quarterly reports regarding the status and management of commercial issues for Plenary’s senior leadership team.
  • Broad commercial work across other projects, with specific responsibilities prescribed on an as-needed basis.

Qualifications

  • Minimum of 6 years of working full-time on commercial issues (as a commercial lead, with or without formal legal training) at a general, sub-contractor, or firm, with focus on construction, contracts, and related issues in the United States.
    • External counsel experience is acceptable as well
    • Heavy civil construction, PPP projects, or similar experience is preferred
  • Experience with review, negotiation and enforcement of construction contracts and managing construction disputes.
  • Familiarity with the current state of construction-related case law in the United States.
  • Strong work ethic and high level of professional integrity, along with initiative, commitment, and attention to detail.
  • Self-starter with the ability to work both independently with minimal guidance and in a team setting.
  • Fluency in Spanish is an asset.
